Returns and Shipping Policy

At HerbsMagicShop.nl, we offer high-quality products, including lotus products, smoke herbs, and tinctures. To ensure the quality, safety, and integrity of our products, the following comprehensive conditions apply:

1. Returns and Packaging

1.1 Seal Required

Returns are only accepted if the shipping box is completely sealed and the seal has not been broken or damaged. Products with a broken or damaged seal are not eligible for return, exchange, or refund.

1.2 Hygienically Sensitive Products

In accordance with Article 7:18 paragraph 1 of the Dutch Civil Code, the right of withdrawal does not apply to products that are hygienically sensitive or that may deteriorate quickly in quality. This applies to all products from HerbsMagicShop.nl, including lotus products, smoke herbs, and tinctures.

1.3 Packages Without an Intact Seal

Packages returned without an intact seal will not be accepted.

2. Responsibility for Shipping

2.1 Transport and Liability

HerbsMagicShop.nl is not liable for products that are lost, damaged, or go missing during shipping. It is the customer’s responsibility to provide a correct delivery address and to send valuable shipments with tracking.

2.2 Lost Packages

In the event of lost packages, we will initiate an investigation with the carrier, which may take up to 30 days. During this investigation, HerbsMagicShop.nl is not liable for loss or damage.

3. Product Quality and Integrity

The quality and integrity of the products are guaranteed only as long as the packaging remains undamaged and sealed. Opened, damaged, or broken packaging is not eligible for return, exchange, or replacement. We comply with relevant Dutch and European laws and regulations, including the Commodities Act (Warenwet), NVWA guidelines, and, where applicable, HACCP principles.

4. Liability

HerbsMagicShop.nl is not liable for damage or loss resulting from improper use, transport, or storage of products after shipment. Maximum liability is limited to the value of the ordered products (excluding shipping costs), except in cases of intent or gross negligence.

5. Replacement Shipment Instead of Refund

HerbsMagicShop.nl does not automatically offer refunds for lost or damaged orders. A replacement shipment will be offered first. The replacement shipment will be resent within one month, taking into account the delivery times of our suppliers. Only when a replacement shipment is not possible or is refused by the customer may a refund be considered in exceptional cases. This policy applies to all products, including lotus products, smoke herbs, and tinctures.

6. Exception to the Right of Withdrawal

In accordance with Article 6:230m paragraph 2 of the Dutch Civil Code, the right of withdrawal does not apply to products that are hygienically sensitive or whose seal has been broken.

7. Complaints Procedure

7.1 Notification

Complaints regarding damaged, missing, or non-conforming products must be reported within 24 hours of receipt via our contact form.

7.2 Investigation Period

In the event of lost or damaged shipments, an investigation will be initiated with the carrier (up to a maximum of 30 days). During this investigation, HerbsMagicShop.nl is not liable for loss or damage to the products.

7.3 Proof Requirement

HerbsMagicShop.nl reserves the right to request proof of the condition of the packaging and products upon receipt or during the return process.

8. General Provisions

By placing an order with HerbsMagicShop.nl, the consumer fully accepts this policy. HerbsMagicShop.nl reserves the right to amend or supplement this policy in accordance with legal requirements or operational necessity.
